Family Accuses Fiske Elementary of Throwing Son Out into Cold

Chicago Public Schools is facing a lawsuit by an Englewood mother who says her son was thrown out of school and forced to stand in the cold. 


The incident happened at Fiske Elementary back in late March. The boy's family says he had been involved in a fight earlier that day but didn’t start it. School surveillance video shows what happened after.


It shows the 9-year-old boy being shoved out of his elementary school by a security guard and into the cold. According to his family, it was 40 degrees that day. 


The lawsuit says the principal and a counselor looked on as this happened. It goes into further detail, saying minutes later the school's staff called 911 to report the kid as missing. Then the school staff called 911 again, this time requesting an ambulance because the boy was injuring himself.


The family's attorney Dan Herbert says that's a lie, because an officer found the 9-year-old crying outside the school, once he realized all the doors were locked. 


CPS officials didn't waste any time, and within hours removed the security guard from his position. 


There's now a full investigation into why this was not brought up sooner. CPS released a statement that says in part, "these allegations are deeply disturbing, and we are fully committed to holding accountable any adult whose actions could have endangered a student."


The family attorney and the boy's mother say he was seen as a problem child because he always brought up being bullied. 


The lawsuit is against the city, the school principal, the security guard, and the counselor. It also seeks an undisclosed payment for damages.
