State’s Attorney Kim Foxx Speaks Out On Smollett Case

Chicago is in turmoil after all the charges against Jussie Smollett were dropped by State’s Attorney Kim Foxx's team of prosecutors.

Foxx says the office works closely with CPD and they do the prosecuting. As the investigation unfolded, she determined she needed to recuse herself.

A relative of Smollett reached out to Foxx over concerns about the investigation being leaked to the media, back when Smollett was still considered victim.

Foxx adds Smollett’s case wasn’t treated differently. Smollett was charged with a class four felony, the lowest felony charge making it a possibility for the case to fall under a diversion.

“…even if they’re guilty of a crime, if they meet certain criteria, if the background is a low level offense…,” says Foxx.“They’re eligible to have their case disposed of in diversion…they don’t have to have a finding of guilt or admission.”

Even if he was found guilty Foxx says he would have to do community service, not serve prison time.

After CPD released about 60 pages of their investigation reports, officials said they were told by the state’s attorney office to stop giving away those documents.

After charges were dropped there was a change of tone in Smollett’s defense. His attorney says the city owes Smollett an apology.
